Do I need to withdraw my I-751 Joint filing because my wife and I are getting a divorce?

I applied for the joint I-751 December 24 2014 and I just found out that my wife wants to file a divorce. My case is almost 6 months now with the Vermont center. I waited this long and it breaks my heart to have to withdraw the application and start all over again with the I-751 waiver. what should I do?

Answer:

Because you filed a joint I-751 with your wife that doesn’t mean that you will have to withdraw the application.

If you get a Divorce before it is adjudicated you can notify the USCIS. Then ask that the Joint Petition be considered as an I-751 waiver. I hope this information is helpful to you. Good Luck!!
